$5.5 million fine for spamming in australia

Wayne Mansfield faces financial ruin after Federal Court Justice Robert Nicholson yesterday fined him $1 million and his business seminar company Clarity1 Pty Ltd $4.5 million in a 19-page judgment.

Clarity1 sent more than 213 million commercial emails, 41 million of them to 5.6 million addresses illegally “harvested” from the internet, between April 2004 and April 2006.

The nature of the breaches of the Spam Act, enacted in April 2004, was “flagrant and unapologetic”, the judgment said.

Australian Communications and Media Authority anti-spam team manager Bruce Matthews said it was the first successful prosecution under the Act. “We are very happy with the decision because we think it sends a very strong message to potential Australian spammers that we will vigorously enforce the Spam Act,” he said.

Whereas, on 4 December 5, 2005, the board authorized the President and General Counsel to enter into negotiations relating to proposed commercial and technical terms for the .ASIA sponsored top-level domain (sTLD) with the applicant, DotAsia Organisation Limited,

Whereas, on 18 July, 2006, ICANN announced that negotiations with the applicant for the .ASIA sponsored top-level domain had been successfully completed, and posted the proposed .ASIA sponsored TLD registry agreement on the ICANN website,

Whereas, the Board has determined that approval of the agreement, and delegation of a .ASIA sponsored top-level domain to DotAsia Organisation Limited would be beneficial for ICANN and the Internet community,

ICANN Registry Services Evaluation Process (NEW POLICY)ICANN has implemented a new policy that allows registries to submit proposed new services or changes to existing services without waiting for their contract renewal.ICANN announces the implementation of the process for review of new gTLD Registry Services and adoption of the Registry Services Evaluation Process. The effective date of the Policy is 15 August 2006. The implementation of this process includes an online tool through which gTLD registry operators and registry sponsoring organizations will be able to submit their requests for new registry services to ICANN.

Internet gambling ban added to U.S. port security bill

WASHINGTON (Reuters) - Congress was pushing on Friday to finish legislation that would boost security at U.S. ports, but at the last minute lawmakers added provisions to prohibit Internet gambling.

Rushing to finish their work by the weekend to go home and campaign for elections in which control of Congress is at stake, lawmakers were linking up unrelated measures in an effort to get them approved.

The House passed an Internet gambling ban earlier this summer, but the bill had difficulty moving in the Senate. However it was a priority of Senate Republican Leader Bill Frist of Tennessee, and attaching it to the popular port security bill appeared aimed at insuring its passage.

Apple on August 29, 2006 announced that Dr. Eric Schmidt, chief executive officer of Google, was elected to Apple’s board of directors at their meeting today. Eric also sits on Google’s board of directors and Princeton University’s board of trustees.

“Eric is obviously doing a terrific job as CEO of Google, and we look forward to his contributions as a member of Apple’s board of directors,” said Steve Jobs, Apple’s CEO. “Like Apple, Google is very focused on innovation and we think Eric’s insights and experience will be very valuable in helping to guide Apple in the years ahead.”

“Apple is one of the companies in the world that I most admire,” said Eric Schmidt. “I’m really looking forward to working with Steve and Apple’s board to help with all of the amazing things Apple is doing.”
